OMAX TELECOM SMS CODE OF CONDUCT

This SMS Code of Conduct is an annex to the Messaging Service Agreement entered into by OMAX TELECOM and its customers. It defines the rights, obligations, and acceptable use policies for sending, receiving, and managing SMS A2P (Application-to-Person) traffic.
1. SCOPE
1.1 This Code of Conduct applies to all SMS A2P traffic transmitted through OMAX TELECOM’s platform and networks.
1.2 By subscribing to OMAX TELECOM’s SMS services, the customer agrees to adhere to this Code of Conduct.
1.3 OMAX TELECOM reserves the right to modify this Code of Conduct as necessary to comply with regulations and industry standards. Customers will be notified of any changes.
2. CUSTOMER OBLIGATIONS
2.1 Customers must ensure that all SMS traffic:
- Complies with applicable telecommunications and data protection laws.
- Adheres to regulatory guidelines and decisions in destination countries.
- Does not contain misleading, offensive, defamatory, or fraudulent content.
- Does not infringe any third-party intellectual property rights.
- Does not involve unsolicited, spam, or deceptive advertising messages.
- Does not manipulate sender IDs or transmission metadata unlawfully.
2.2 Customers must prohibit their users from sending:
- Unsolicited bulk SMS or spam.
- Fraudulent or deceptive messages.
- Messages containing malware, phishing attempts, or illicit URLs.
- Messages that could damage OMAX TELECOM’s reputation or that of its partners.
2.3 Customers must obtain explicit opt-in consent from recipients before sending marketing or promotional SMS.
2.4 Customers must provide a clear and effective opt-out mechanism for recipients who no longer wish to receive SMS messages.
2.5 Customers must promptly cease sending any SMS content deemed non-compliant by OMAX TELECOM.
3. MONITORING AND ENFORCEMENT
3.1 OMAX TELECOM reserves the right to:
- Monitor SMS traffic for compliance with this Code of Conduct.
- Request evidence of user consent (opt-in records) from customers.
- Suspend or terminate services for non-compliance.
3.2 If a customer is found in violation of this Code of Conduct, OMAX TELECOM may:
- Issue a warning and request corrective action.
- Suspend SMS services immediately if violations persist.
- Terminate the customer’s account without refund for repeated breaches.
3.3 Customers are required to implement fraud prevention measures, including:
- Blocking unsolicited or suspicious SMS traffic.
- Implementing sender ID validation.
- Monitoring traffic for abnormal patterns or excessive complaints.
4. LIABILITY AND INDEMNIFICATION
4.1 Customers are fully responsible for the content of the SMS messages they send and any damages arising from non-compliance with this Code of Conduct.
4.2 OMAX TELECOM shall not be liable for message delivery failures caused by third-party mobile network operators or regulatory restrictions.
4.3 Customers agree to indemnify OMAX TELECOM against any claims, penalties, or damages resulting from their violation of this Code of Conduct.
5. GOVERNING LAW
5.1 This SMS Code of Conduct is governed by the laws of England & Wales.
5.2 Any disputes related to this Code of Conduct shall be resolved in the courts of England & Wales.
