TERMS OF USE FOR OMAX TELECOM SMS SERVICE

By accessing and using the SMS services provided by OMAX TELECOM, a brand operated by OMAX GROUP LTD, you agree to comply with the following terms and conditions. If you do not agree with these terms, you are not permitted to use the service.
1. DEFINITIONS
1.1 Service: The SMS messaging service provided by OMAX TELECOM, including but not limited to bulk messaging, API integration, and OTP services.
1.2 Customer: Any individual or entity using the SMS service provided by OMAX TELECOM.
1.3 Unsolicited Traffic (Spam): SMS messages sent without the recipient’s explicit consent, including promotional or commercial messages.
1.4 Account: The user account registered with OMAX TELECOM for accessing and using SMS services.
1.5 Message Content: Any text, numeric, or multimedia content sent via SMS using the OMAX TELECOM platform.
2. CUSTOMER OBLIGATIONS
2.1 The Customer agrees not to use the SMS service for:
- Sending spam, fraudulent, illegal, or deceptive messages.
- Distributing content that is offensive, defamatory, obscene, or violates any law.
- Impersonating any person or entity without authorization.
- Sending messages containing malware, phishing attempts, or links to harmful websites.
- Engaging in any activity that violates the policies of mobile network operators.
2.2 The Customer must comply with applicable data protection laws, including GDPR, when handling recipients’ personal data.
2.3 The Customer shall maintain opt-in and opt-out mechanisms for SMS recipients to ensure compliance with legal and regulatory requirements.
2.4 The Customer acknowledges that OMAX TELECOM may monitor SMS traffic for compliance and reserves the right to suspend services for any suspicious activity.
3. ACCOUNT SUSPENSION AND TERMINATION
3.1 OMAX TELECOM reserves the right to immediately suspend or terminate the Customer’s account if any of the following occurs:
- Violation of any terms outlined in this agreement.
- Sending unsolicited SMS messages (spam).
- Engaging in fraudulent or illegal activities using the service.
- Non-payment of due invoices.
3.2 No Refund Policy: If a Customer’s account is suspended or terminated due to a breach of these terms, any remaining balance in the Customer’s account will be forfeited, and no refund shall be provided.
3.3 Customers may appeal an account suspension by providing written evidence to OMAX TELECOM within 7 days of suspension. OMAX TELECOM reserves the right to uphold or revoke the suspension at its sole discretion.
4. PAYMENT, BILLING, AND REFUNDS
4.1 All payments must be made in accordance with the agreed-upon pricing and payment terms as stated in the Customer’s service order.
4.2 OMAX TELECOM debits transmitted SMS messages according to its transmission logs. These logs are considered accurate and final.
4.3 Refunds are not provided for:
- Undelivered SMS messages due to recipient network issues.
- Unused credit in cases where the Customer violates these terms.
- Voluntary account closure by the Customer.
4.4 Customers must raise any billing disputes within 14 days of invoice issuance. OMAX TELECOM will review the dispute and respond within 30 days.
5. LIABILITY AND INDEMNITY
5.1 OMAX TELECOM is not liable for:
- SMS delivery failures caused by third-party mobile network operators.
- Delays, errors, or disruptions in service due to factors beyond its control.
- Any damages arising from Customer’s misuse of the service.
5.2 The Customer agrees to indemnify OMAX TELECOM against any claims, damages, or penalties arising from non-compliance with these terms.
6. CONFIDENTIALITY
6.1 Both parties agree to keep confidential any proprietary or sensitive information shared during the course of service usage.
6.2 Confidentiality obligations shall survive termination of the Customer’s account.
7. AMENDMENTS
7.1 OMAX TELECOM reserves the right to amend these terms at any time. Customers will be notified of significant changes via email or platform notifications.
7.2 Continued use of the service after such amendments constitutes acceptance of the revised terms.
8. GOVERNING LAW
8.1 These Terms of Use shall be governed by and construed in accordance with the laws of England & Wales.
8.2 Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of England & Wales.
